Mark Glusing, President of Poker.com Inc, and respected law academic Professor I Nelson Rose both feel that they have come up with a way to neutralize American legal opposition to online poker room activity, according to a media release from the company this week.

 

They hope to achieve this through a skill based system of online poker games that has been obtained from Swiss company Blue Diamond International Capital Inc, from which they have obtained a provisional patent and software assets.

 

“Certain jurisdictions in the U.S and Canada look upon the wagering of skill based games as not contravening gambling laws. Management considers the Skill Poker system as one of these skill based games,” says Glusing.

 

The company paid Blue Diamond US$50,000 and issued 3,000,000 shares in its common stock. In addition, Blue Diamond will receive the greater of US$3,500 per month or 4% of the gross revenue received by the company from operating games using the technology of the provisional patent. In the event that the technology is further licensed by Poker.com Inc. to a third party, Blue Diamond will also receive 20% of any initial license fee and 4% of the gross revenue of any such licensee.

 

According to the release, Poker.com plans to use the Skill Poker concept in the operation of its own skill based online poker card rooms marketing directly to players in the United States, Canada and worldwide. Once developed, Poker.com Inc.’s poker card room will be the only legal online system of gaming with all operations including the game servers located on North American soil.

 

The company has formed Skill Poker.com Inc., a wholly owned subsidiary registered in the State of Washington for the purpose of developing and operating the Skill Poker concept. Poker.com Inc. has acquired ownership of all materials in relation to the games of Skill Poker and Skill Blackjack, in addition to the domain names SkillPoker.com, SkillBlackjack.com, SkillOmaha.com, SkillHoldem.com and SkillStud.com.

 

The provisional patent application filed with the United States Patent and Trademark Office covers a system for determining the skill level in a tournament setting for many different card games including all forms of poker.

 

In what was almost a post script to the main press release, Glusing updated the media on his attempts to reverse the hi-jacking of the Poker.com domain earlier this year. His appeal to ICANN that the present registrants of the domain, on which he claims to have a long lease, have illegally taken it back has thus far failed. However, ICANN has suggested that action could more appropriately to be commenced against ALA Corp (the previous registrant of the domain). Poker.com Inc is to pursue this.
